COURSE DESCRIPTION
Course content

I. Historical review of the development of judicial control of administration: the French model of special administrative courts. Anglo-American model of ordinary courts. Mixing of two models ("administrator-judge" institute). The breadth of jurisdiction of judicial control of the administration (dispute of ascertainment, dispute of annulment, dispute of full jurisdiction). Autonomy or attachment of administration and judiciary. II. Administrative dispute in domestic law: Constitutional basis of judicial supervision of administration in Croatia. Basic characteristics of an administrative dispute: types, object, jurisdiction, parties to the proceedings, initiation and course of the proceedings, decisions, legal remedies (ordinary and extraordinary), the binding nature of court decisions. III. Supervision of the work of the administration in other court proceedings: Supervision of the work of the administration in criminal proceedings, misdemeanor proceedings, civil litigation proceedings (especially: labor-legal disputes and liability for damage), and enforcement proceedings. IV. Constitutional judicial control of the administration: Special judicial protection of natural and legal persons (violation of constitutional rights by acts and actions of the administration, data protection, etc.). Constitutional court protection of the rights of physical and legal persons violated by the actions of the administration. Constitutional court supervision over individual and general normative acts of the administration. V. Basics of the European system of protection against illegal actions of the administration: Convention for the Protection of Human Rights and Fundamental Freedoms of the Council of Europe and proceedings before the European Court of Human Rights in Strassbourg. The Charter of Fundamental Rights of the European Union and the Court of Justice of the EU.

Course learning outcomes

define judicial supervision over administration, explain and distinguish types of judicial supervision, enumerate the basic principles of administrative disputes, parties in administrative disputes and explain the powers of administrative courts and the High Administrative Court of the Republic of Croatia, compare models of judicial supervision and analyze the advantages and disadvantages of each model, analyze the national and European human rights protection system, especially the one before the Constitutional Court of the Republic of Croatia, i.e. the European Court of Human Rights, which will enable them to take a broader view of administrative activities and protection mechanisms against illegal administrative actions, define and explain the legal arrangement of administrative-judicial protection with an emphasis on legal remedies (mechanisms of legal protection), analyze the judicial practice of first-instance administrative courts in the Republic of Croatia, the High Administrative Court of the Republic of Croatia, the Constitutional Court of the Republic of Croatia, apply the acquired knowledge from the specified subject to concrete examples and critically argue judicial practice with the interpretation of legal texts of selected administrative dispute institutes,
