COURSE DESCRIPTION
Course content

Traditional types (models) of criminal procedure. The most important feature of the English criminal procedure as an accusatorial type of procedure. The tendency to introduce accusatorial procedural forms in contemporary criminal procedures of European countries. Harmonization of criminal procedures of the member states of the European Union. Changes in the principles of Croatian criminal procedural law as a consequence of its latest development: 1. Principle of material truth, 2. Principle of fairness of the trial, 3. Principle of officiality of criminal prosecution, 4. Principle of the legality of criminal prosecution, 5. Inquisitorial principle and principle of the right to be heard 6. Principle of the unfettered evaluation of evidence, 7. Principle of judicial independence, 8. Principle of judicial review of criminal prosecution A new model of the state attorney's investigation. State Attorney's Office - its new organization and legal position. The legal position and task of the state attorney in criminal proceedings; function of criminal prosecution and investigation. Changes in the procedural position of the defendant and his defense counsel. The new location of the court; the function of supervision over the respect of fundamental human rights and freedoms in the previous procedure.

Course learning outcomes

After completing the course, the student will be able to: 1. Analyze and interpret the existing model of criminal procedure , 2. Define and describe the fundamental principles of Croatian criminal procedural law, 3. Interpret the functions of the basic criminal procedure subjects, 4. Analyze and connect the jurisprudence of the ECtHR and its influence on the development of Croatian criminal procedural law, 5. Critically reflect on the success of the reform of the Croatian criminal procedure,
