Course content |
The content of this course implies the consideration of European criminal law as a broader term used to denote various contents. This means, on the one hand, the criminal law of the Council of Europe - constituting conventions and related agreements and decisions of the European Court of Human Rights - and, on the other hand, criminal law developing within the EU. Thus, this course is divided into two parts: the first part is dedicated to the criminal law of the EU, and the second part to the criminal law of the Council of Europe. The first part is aimed at introducing students to EU powers in the field of criminal law before and after the Lisbon Treaty, with emphasis on specially selected topics such as: protection of EU financial interests, cybercrime, European Arrest Warrant, etc. European Convention for the Protection of Human Rights and Fundamental Freedoms developed within the Council of Europe is the most important legal instrument for the protection of individual rights in Europe, which significantly affects national criminal justice systems. to life, prohibition of torture, ne bis in idem, right to personal liberty and security, etc.). The content of the first part of the course includes the following topics: 1. Roots, institutional system and legal framework of criminal law cooperation in the EU 2. Changes to the institutional framework of "European Judicial Cooperation" introduced by the Treaty of Lisbon 3. Mutual recognition between Member States in criminal matters (European Arrest Warrant, etc.) 4. Establishment of supranational institutions (role of Eurojust, Europol, European Public Prosecutor - in stat nascendi) 5. Protection of the EU's financial interests The content of the second part of the course includes the following topics: 1. European Convention for the Protection of Human Rights and Fundamental Freedoms - origin, content, practical application 2. Right to life - art. 2 3. Prohibition of torture - Art. 3 4. The right to personal liberty and security - Art. 5 5. The right to a fair trial - Art. 6 6. The right to respect for private and family life - Art. 8 |

After completing the course the student will be able to: Explain the historical development of criminal law cooperation in the EU, Define basic term and concepts of EU criminal law, Define and distinguish the powers and right of access to the European Court of Human Rights (Council of Europe), Explain the correlations between the ECtHR and the Court of Justice, Apply the acquired knowledge to solve practical problems (solving hypothetical cases), |
