COURSE DESCRIPTION
Course content

The course introduces students to the criminal dimension of errors in medicine. Many cases from Croatian case law are analyzed, and such examples explain the problems of determining causality and the limits of negligence. Attention is also paid to other forms of criminal liability of doctors. Students are introduced to civil liability for damages in medicine and the consequences of violating the rules of the health profession. Indication of liability insurance systems in the health sector is also pointed out. Students are introduced to the sources and forms of financing health care activities and the sources of financing the transplantation of human body parts. The issue of arranging the conclusion of contracts on specialist training of doctors of medicine as well as the issue of taxation of health services is also analyzed. The content of the course is divided into three parts that include the following topics: Part One, Financing the Health System, Models of Health Systems, Financing Public Health in the Republic of Croatia, Sources of Financing the Transplantation of Human Body Parts, Tax System in the Health Care System, Arranging the Conclusion of Contracts on Specialist Training of Medical Doctors Second part, Civil liability in medicine, contractual and non-contractual liability for damage in medicine, subjective (culpable) and objective (causal) liability for damage, violation of the rules of the health profession (medical error), violation of the right to bodily integrity in medicine, material and non-pecuniary damage in medicine, causal link as a presumption of liability for damage in medicine, liability insurance systems in health care Third part, Criminal liability of a doctor for error, criminal offense of negligent treatment, problem of defensive medicine, how to causally interpret causality and responsibility for consequences; difference versus lay interpretation, analysis of cases from recent Croatian case law: analysis of evidence and findings and expert opinions, expert examination, analysis of decisions made and critical review, criminal assumptions responsibilities for: disclosing professional secrets (special reference to HIV-positive patients), failure to provide emergency medical care, treatment without consent (special reference to the problem in dealing with Jehovah's Witnesses), the spread and transmission of infectious diseases (with special reference to working with HIV-positive people)

Course learning outcomes

Students are expected to attend lectures and exercises regularly, which they will confirm with their signature. In the case of online classes, Students are expected to regulary access distance learning systems and the download of distance learning systems materials is expected.
