Course content |
Course Convention Law and Criminal Justice introduces students to criminal law aspects of protection of fundamental human rights and freedoms as proclaimed by the European Convention for the Protection of Human Rights human rights and fundamental freedoms and the way in which they are elaborated in the case law of the European Court of Human Rights. In this sense, the origin and development of the Convention and the legal nature of the judiciary are first explained and aslo ECtHR cases and their impact on the national legal systems of individual countries. Special emphasis is placed on to the analysis and study of individual judgments of the ECtHR in the field of protection of the right to life, prohibition torture, the right to liberty and security, the right to a fair trial, the principle of legality, the right to respect for private and family life, the right to freedom of expression, the right to an effective legal order remedy, prohibition of discrimination with special interest in judgments against the Republic of Croatia. Then explains how ECtHR judgments are executed by analyzing individual legislative interventions in criminal legislation and changes in the practice of criminal procedure bodies to which it is came under the influence of recent ECtHR decisions. The content of the course implies analysis of the following topics: 1. European Convention for the Protection of Human Rights and Fundamental Freedoms - origin, content, practical use 2. The right to life 3. Prohibition of torture 4. The right to liberty and security 5. The right to a (fair) trial 6. Principle of legality 7. The right to respect for private and family life 8. The right to freedom of expression, 9. The right to an effective remedy 10. Prohibition of discrimination 11. Mechanism for monitoring compliance with the Convention 12. Enforcement of judgments of the European Court of Human Rights |
