COURSE DESCRIPTION
Course content

The aim of the course is to acquaint students with the basic concept and characteristics of criminal law, to acquire knowledge about the basic institutes of criminal law and the material of the Criminal Code and to develop basic skills of critical analysis. The content of the course includes the treatment of the following topics: 1. The term of criminal law Criminal law in a broader and narrower sense, subsidiarity, fragmentarity, accessory, relation with other branches, rights, primary and secondary criminal legislation, division of criminal law into general and special part, principle of legality. 2. Criminal offense Material and formal notion of criminal offense, division of criminal offenses according to types of descriptions of criminal offences, inaction, causality, relation of descrption of criminal offence and wrongdoing, self-defence, necessity, guilt, principle of guilt, accountability, reduced accountability, self-induced mental incapacity , intentions and negligence, ground for excuse. misapprehension, apologetic reasons, analysis of relevant cases from case law. 3. Stages of the offense Preparatory actions, attempted crime, special cases of attempt, inappropriate attempt, voluntary, withdrawal, effective remorse, analysis of relevant case law examples. 4. Complicity Possible concepts of complicity, complicity in a broader and narrower sense, the Croatian model of complicity, co-perpetration, ,indirect perpetration, incitement, aiding, accessory participation in the narrow sense, accountability for excess,, analysis of relevant case law examples. 5. Concurrence of criminal offencesand continuing criminal offense Real and ideal concurrence, learning about the unity of action, apparent concurrence: specialty, subsidiarity and consumption, sentencing for concurring offenses, continuing criminal offense, analysis of relevant court cases practice. 6. Sanctions A new concept of sanctions in Croatian criminal law, penalties: imprisonment and fines, sentencing and aggravating and mitigating circumstances, conditional release, conditional sentence, security measures, imposition of sanctions

After listening to the lectures and passing the exam, the student should be able to: Explain the content and structure of criminal law, Define basic concepts and terms, Link and relate the basic institutes of criminal law, Discuss tndividual problems , Critically analyze the offered cases from case law,
