COURSE DESCRIPTION
Course content

The aim of the course is to acquaint students with the basics of criminal procedural law, through the analysis of basic terms of criminal procedural law, which provides knowledge about the basic institutes of criminal procedural law and trains students to master practical skills of applying theoretical knowledge to practical problems. The content of the course includes analysis of the following topics: Terms of criminal procedure, term of criminal law in a broader sense, term of criminal procedural law, sources of criminal procedural law - termt; primary sources; ancillary sources, notion of subjects of criminal proceedings and notion of parties, notion of procedural subjects, procedural participants, bodies of criminal procedure, notion of parties, notion of court, position of court in Croatian legal order, jurisdiction of courts, actual jurisdiction, territorial jurisdiction, court composition, appointment of judges, concept and functions of prosecutors in criminal proceedings, types of prosecutors, concept and legal position of the State Attorney's Office, principles related to the regulation of criminal prosecution by the State Attorney, organization of the State Attorney's Office, real and territorial jurisdiction, term of subsidiary prosecutor, term of private prosecutor , the notion of the defendant, who can be the defendant, the procedural position of the defendant, the notion of the defense counsel, the optional and obligatory assistance of the defense counsel, defense counsel for the poor defendant, measures to ensure the presence of persons needed in the proceedings, arrest, custody, pre-trial detention, basic forms of Croatian criminal proceedings, general overview of criminal proceedings, pre-trial proceedings, criminal charges, criminal investigations, urgent evidentiary actions , investigation and research, evidentiary actions, judicial review of prosecution, indictment and judicial review of indictment, hearing and verdict, general hearing, preconditions for holding a hearing, course of hearing, verdict, sentencing, types of verdicts, announcement of verdict, drafting and delivery of written verdict, legal remedies, regular legal remedies, extraordinary legal remedies, criminal order procedure, notion of facts established in criminal proceedings and types of those facts, ways of establishing facts, notion of evidence, term evidance and stages of proving process, presentation of evidence and evaluation of evidence, testimony of defendant: a) general , b) interrogation of the defendant, testimony of witnesses: a) in general, b) interrogation of witnesses evidence, expert testimony, documents, technical recordings of facts
