COURSE DESCRIPTION
Course content

The objectives of the course are to present and explain the concept, purpose and determinants of Criminal Law and Criminal Code, acquiring knowledge about the basic institutes of Criminal Law and their categorization, developing the ability to discuss and critically reflect on positive provisions. The content of the course is divided into five parts: First part Criminal law, the concept of subject and purpose of criminal law, the relation of criminal law to others branches of law, crime and the science of crime, history of criminal law and criminal law sciences, theories of criminal law, history of Croatian criminal law, criminal, disciplinary and misdemeanor criminal law. The second part Criminal law, primary and secondary criminal legislation, principle of legality (meaning, the principle that the law must be written, the prohibition of analogy, the principle of certainty and the prohibition of retroactive effect criminal law), interpretation of criminal law, application of Croatian criminal law in territory (application to criminal offenses committed in the territory of the Republic of Croatia: territorial principle, flag principle ship and the principle of aircraft registration, transfer of criminal proceedings to a foreign state; application to criminal offenses committed outside the Republic of Croatia: protective or real principle, principle of active and passive personality, universal principle). The third part Criminal offense and its elements, the concept of criminal offense (material and formal concept), action (theories of action and negative function of action), essence of criminal offense (types of criminal offenses according to types of essence of criminal offenses, omission: division of criminal offenses and guarantee relations; ), unlawfulness (self-defence: concept and justification, attack, defence, restrictions, necessary assistance, putative necessary defense, exceeding the limits of self-defence; necessity: concept and types, necessity as a reason for excluding illegality and necessity as a reason for excluding guilt, danger and elimination of danger, lawful use of coercive means, superior order, consent of the injured party, treatment of private persons by law, the right to corporal punishment of children, conscientious objection), guilt (certain theories of guilt, accountability and mental incapacity: methods of determination, biopsychological the possibility of understanding and governing, self-induced mental incapacity, significantly reduced mental incapacity, intention and its forms: concept, direct intention, indirect intention, special types of intention; negligence and its forms: concept and meaning, conscious and unconscious negligence, objective and subjective criterion of negligence; guilt in criminal offenses qualified with more serious consequences, awareness of wrongdoing, misapprehension: fundamental division ,misapprehension about the description of the crime, misapprehension about the circumstances that exclude wrongdoing, misapprehension about wrongdoing and misapprehension about the circumstances of necessity that excludes guilt). Special preconditions of criminality (objective conditions of criminality, insignificant act, statute of limitations). The fourth part Special forms of criminal offense, preparatory actions and attempt (possible stages of criminal offense, preparatory actions, attempt: criminality, characteristics, special forms of attempt, inappropriate attempt; completed criminal offense, voluntary abandonment: concept and effects, failed abandonment, effective remorse), perpetration (the concept of perpetration and forms, perpetration and certain theories, accessory participation in the narrow sense, indirect perpetration, complicity, instigation, aiding, independence of guilt of individual participants, necessary participation, concurrence of various forms of participation), concurrence and continuing criminal offense, ideal, real and apparent concurrence, continuing criminal offense). Part five Criminal sanctions, dualistic system of criminal sanctions (theories on the purpose of punishment, sentences in Croatian criminal law: main and secondary, death penalty, imprisonment, fine), suspended sentence (concept and meaning, types, presumptions and revocation), sentencing (concept and meaning, penal frameworks, grounds for sentencing, circumstances important for sentencing, prohibition of double valuation, mitigation of sentence, release from sentence, sentencing for concurring acts, sentencing a convicted person), security measures (notion of security measures, principle of proportionality,,certain/individual security measures), informal sanctions, special criminal measures (confiscation of property, confiscation of objects, public announcement of a verdict), legal consequences of a conviction, rehabilitation and provision of data from criminal records. amnesty and pardon.

Course learning outcomes
