Course content |
Objectives of the course • Introducing students to the origin and historical development of the EU, changes to the Founding Treaties and the process of EU enlargement with special reference to the accession of the Republic of Croatia to membership in the European Union; • Acquiring knowledge about the basic terms and concepts of EU law (sources of EU law, principles of EU law, powers of EU institutions, proceedings before the Court of Justice of the European Union and judicial practice related to the internal market); • Understanding of the previous procedure before the Court of Justice of the European Union as a mechanism that ensures uniform application of EU law in all EU member states; • Acquiring knowledge about the Council of Europe in general and in particular about the European Convention for the Protection of Human Rights and Fundamental Freedoms and about the conditions for access to the European Court of Human Rights; • Developing basic skills of critical analysis and training students for the so-called case study problem solving technique with the help of cases from the practice of the Court of Justice of the European Union (Luxembourg) and the European Court of Human Rights (Strasbourg) Content 1. History of European integration and EU expansion - in this part, students are introduced to the process of integration in Europe in general, and in particular to the emergence of European communities (European Coal and Steel Community, EURATOM and European Economic Community) as forerunners of today's EU. Students are then introduced to the waves of EU enlargement, and special attention is paid to the accession of the Republic of Croatia to the EU. 2. Sources of EU law - in this part, students are introduced to the sources of EU law. Thus, students will become familiar with the Founding Treaties and all their amendments, as well as the general principles of law as the primary sources of EU law. The secondary law of the EU includes legal acts of the institutions (regulations, guidelines and decisions), international agreements concluded by the EU with third countries or international organizations, and the jurisprudence of the Court of Justice of the European Union. 3. Basic principles of European law - despite a lot of legal regulations, there are still certain areas that are not regulated. In order to ensure that there are no legal gaps, the Court of Justice of the European Union has taken upon itself the role of filling them. The aim of this part of the lecture is to show the application of general principles of law in the practice of the Court of Justice of the European Union. 4. EU Institutions - in this part, students gain knowledge about the structure of the fundamental institutions of the European Union and understand their role in the decision-making process in the EU. 5. European Court - students acquire knowledge about the organization, selection of judges and different branches of jurisdiction of the Court of Justice of the European Union 6. Preliminary proceedings before the Court of Justice of the European Union 7. Effects of EU law in the internal law of member states - knowledge and understanding of the relationship between European law and national law, especially national constitutional law 8. EU internal market - in this part, students are introduced to 4 fundamental market freedoms (freedom of movement of people, goods, services and capital) and possible limitations of these freedoms, with special emphasis on studying the relevant case law of the Court of Justice of the European Union. 9. European citizenship - students get to know the concept of EU citizenship, how it is acquired or lost, what rights derive from it and under what conditions a citizen of an EU member state can be expelled from the host country 10. Protection of fundamental rights in the EU - in this part, students are introduced to the content of the Charter of Fundamental Rights of the EU and the way to protect human rights within the EU 11. Law of the Council of Europe and the European Court of Human Rights - in this part, the student gets acquainted with the Council of Europe, its establishment, institutions and its activities, with special attention being paid to the European Convention for the Protection of Human Rights and Fundamental Freedoms and the mechanisms of protection before the European Court for human rights. |

Students are required to actively participate in a minimum of 55% of classes and to pass the material through two colloquia or the entire course through an exam. The final grade consists of the following elements: regular class attendance, participation in the discussion at lectures and the final exam (written and oral). |
