COURSE DESCRIPTION
Course content

1. Introduction Generally about the freedom of peaceful assembly and association and the way in which these freedoms are stipulated in international documents and the practice of the European Court of Human Rights. In general, the importance of free association in social life and action for the common good. 2. Legal framework for free association. Historical review of the legal regulation of association law in the territory of the Republic of Croatia. The value-normative framework of the right to free association. Basic features of associations as a private law community and differentiation of associations according to other forms of free (private law) association. Legal personality as an institutional element of the association and the acquisition of legal subjectivity. Foundation of the association. Mandatory components of the statute as the basic associational general act. Optional statutory provisions. Registration of associations in the register. Termination of the existence of the association and deletion of the association from the register. 3. Legal relations in the association and management of the association through the association's bodies. Acquisition of membership and obligations and rights of association members. Association bodies and the relationship between association bodies. Association property and disposal of property. 4. Models of supervision over the activities of the association. 5. Funding of associations and effective realization of association goals.

Course learning outcomes

After completing the course, the student will be able to define basic concepts in the way they are set in the national normative framework for civil society organizations at the national level., After completing the course, the student will be able to explain the normative framework for civil society in the Republic of Croatia and identify the fundamental legal features of civil society organizations., After completing the course, the student will be able to interpret the positive obligations of the state established in the jurisprudence of the European Court of Human Rights., After completing the course, the student will be able to analyze and valorize the importance of civil society for the promotion of the rule of law and other democratic values of contemporary liberal democracies., After completing the course, the student will be able to apply the acquired knowledge in order to actively promote civil society through joint or independent action.,
