Naziv i mjesto izvođenja programa

Naziv programa je Interdisciplinarni program cjeloživotnog učenja „Dijete u pravosuđu“.

Predviđeno mjesto izvođenja programa je Pravni fakultet Osijek (Stjepana Radića 13, Osijek) uz mogućnost on-line pohađanja putem sustava za udaljeno učenje. Vježbe iz predmeta Komunikacija i intervjuiranje djeteta se izvode isključivo uživo.

Trajanje programa i stjecanje uvjerenja o završenom programu stručnog usavršavanja

Interdisciplinarni program cjeloživotnog učenja „Dijete u pravosuđu“ koji uključuje teorijska predavanja, praktične vježbe i pismenu provjeru stečenih znanja traje sveukupno četiri mjeseca nakon čega polaznik stječe uvjerenje o stručnoj osposobljenosti u području zaštite procesnih prava djeteta i komunikacije s djetetom.

Uvjerenje o stručnoj osposobljenosti u području zaštite procesnih prava djeteta i komunikacije s djetetom izdaje Pravni fakultet Osijek.

Name and venue of the Program

The name of the program is the Interdisciplinary Lifelong Learning Program “Child in Justice System”.

The planned venue of the program is the Faculty of Law Osijek (Stjepana Radića 13, Osijek), with the possibility of online attendance via the distance learning system. Exercises in the subject Communication and Interviewing Children are performed exclusively live.

The holder and implementer of the Interdisciplinary Lifelong Learning Program “Child in Justice System” is the Faculty of Law Osijek, Josip Juraj Strossmayer University of Osijek.

Duration of the Program and obtaining a certificate of completion of the professional development program

The interdisciplinary lifelong learning program “Children in Justice System”, which includes lectures, practical exercises, and a written test of acquired knowledge, lasts a total of four months, after which the participant obtains a certificate of professional competence in the field of protection of children’s procedural rights and communication with children.

The certificate of professional competence in the field of protection of the procedural rights of the child and communication with the child is issued by the Faculty of Law Osijek.

Ciljevi programa

Elementi interdisciplinarne edukacije, ciljevi programa i ishodi učenja

Interdisciplinarna edukacija prema ovom programu sadrži s jedne strane elemente prava (prava djeteta u obiteljskim sudskim i upravnim postupcima, prekršajnim i kaznenim postupcima, postupcima s prekograničnim elementom, prava djeteta migranata i azilanata), a s druge strane elemente psihologije i psihološke medicine (razvojna psihologija, komunikacija u radu s djecom, oblici komunikacije s ranjivim djetetom i djetetom nesklonima suradnji, prepoznavanje i pristup psihički traumatiziranom djetetu i djetetu izloženom visokokonfliktnom obiteljskom ili drugom okruženju).

Cilj Interdisciplinarnog programa cjeloživotnog učenja „Dijete u pravosuđu“ je stjecanje dodatnih kompetencija i usavršavanje u području zaštite procesnih prava djeteta i komunikacije s djetetom u pravosuđu. U tom smislu,  program je usmjeren stjecanju specifičnih znanja i produbljenom razumijevanju prava djece u vezi sa sudskim i drugim postupcima koji ih se tiču, te specifičnosti pojedinih vrsta postupaka u kojima se dijete pojavljuje u različitim procesnim ulogama. Program je, isto tako, usmjeren razvoju kompetencija komuniciranja s djetetom na djetetovoj razini razumijevanja, uzimajući u obzir dob i zrelost djeteta, njegovo emocionalno stanje, kao i specifičnosti poput djetetovog invaliditeta, poteškoća u komunikaciji ili manipulacije djetetom od strane bliskih osoba.

Nakon uspješnog završetka Interdisciplinarnog programa cjeloživotnog učenja „Dijete u pravosuđu“, polaznici će moći:

• razlikovati materijalna i procesna prava djeteta, različite vrste sudskih i izvansudskih postupaka u kojima se dijete može pojaviti u različitim procesnim ulogama,
• ostvariti komunikaciju s djecom na način primjeren određenoj dobi, zrelosti i emocionalnom stanju djeteta, uzimajući u obzir kontekst postupka i procesne uloge u kojoj se dijete pojavilo,
• ispitati mišljenje i želje djeteta, informirati ga na njemu prikladan način o postupcima koji se vode i koji utječu na djetetova prava, te posljedicama koje proizlaze iz odluka nadležnih tijela,
• prepoznati ograničenja u komunikaciji s djetetom te potrebu zaštite djetetove dobrobiti drugim pravnim mehanizmima.

Polaznici stječu i ostale (specifične) kompetencije, sukladno ishodima svakog pojedinog predmeta.

Interdisciplinary education according to this Program contains, on the one hand, elements of law (children’s rights in family court and administrative proceedings, misdemeanor and criminal proceedings, proceedings with a cross-border element, the rights of children of migrants and asylum seekers), and on the other hand, elements of psychology and psychological medicine (developmental psychology, communication in working with children, forms of communication with vulnerable and uncooperative children, recognition and approach to a psychologically traumatized child and a child exposed to a high-conflict family or other environment).

The goal of the Interdisciplinary Lifelong Learning Program “Children in Justice System” is to acquire additional competencies and training in the field of protecting the procedural rights of children and communicating with children in the justice system. In this sense, the Programme is aimed at acquiring specific knowledge and a deeper understanding of children’s rights in relation to court and other proceedings that concern them, as well as the specifics of certain types of proceedings in which the child appears in various procedural roles. The Program is also aimed at developing the child’s communication skills at the child’s level of understanding, taking into account the child’s age and maturity, their emotional state, as well as specific characteristics such as the child’s disability, communication difficulties, or manipulation of the child by close people.

After successfully completing the Interdisciplinary Lifelong Learning Program “Child in Justice”, participants will be able to:

• distinguish the substantive and procedural rights of the child, different types of judicial and extrajudicial proceedings in which the child may appear in different procedural roles,
• communicate with children in a manner appropriate to the child’s age, maturity, and emotional state, taking into account the context of the proceedings and the procedural role in which the child appears,
• examine the child’s opinion and wishes, inform him/her in a manner appropriate to him/her about the procedures being conducted and affecting the child’s rights, and the consequences arising from the decisions of the competent authorities,
• recognize limitations in communication with the child and the need to protect the child’s well-being through other legal mechanisms.

Participants also acquire other (specific) competencies, in accordance with the outcomes of each individual subject.

Oblik i opis programa

Program obuhvaća 65 sati i od toga 45 sati teorijskih predavanja, a 20 sati praktičnog dijela koji se realizira kroz vježbe komunikacije s djetetom.

Teorijski dio edukacije odnosi se na područje prava, psihologije i medicine, a praktični dio na vježbe i demonstraciju komunikacije s djetetom.

Izvedba programa utvrdit će se posebnim rasporedom predavanja i vježbi uzimajući u  obzir broj polaznika i realizirati će se prema naknadno utvrđenom programu.

Nastava iz obveznih predmeta se izvodi petkom u poslijepodnevnim satima i subotom u vremenskom razdoblju od dva do tri mjeseca, a iz izbornih kolegija prema dogovoru s predmetnim nastavnicima. Predviđeno trajanje programa je ukupno četiri mjeseca.

Format and Program description

The Program includes 65 hours, of which 45 hours are lectures and 20 hours are practical, which is realized through communication exercises with the child.

The theoretical part of the education refers to the field of law, psychology, and medicine, and the practical part to exercises and demonstration of communication with the child.

The implementation of the Program will be determined by a special schedule of lectures and exercises, taking into account the number of participants, and will be implemented according to a subsequently determined program.

Classes in compulsory subjects are held on friday afternoons and saturdays over a period of two to three months, and in elective courses as agreed with the subject teachers. The planned duration of the program is four months in total.

Uvjeti za upis i pohađanje programa

Pravo upisa i pohađanja Interdisciplinarnog programa cjeloživotnog učenja „Dijete u pravosuđu“ imaju sve osobe koje su završile (pred)diplomski studij prava, psihologije, socijalnog rada, medicine, zatim osobe koje su završile programe u sustavu Policijske akademije kao i druge osobe koje su završile drugi (pred)diplomski studij, a u svome su profesionalnom radu u kontaktu s djecom.

Pravni fakultet Osijek kao nositelj i izvoditelj programa će najkasnije trideset dana prije početka njegova izvođenja raspisati javni natječaj za upis na program uz naznaku potrebne prijavne dokumentacije.

Requirements for enrollment and Program attendance

The right to enroll in and attend the Interdisciplinary Lifelong Learning Programme “Children in Justice System” is open to all persons who have completed (undergraduate) studies in law, psychology, social work, medicine, as well as persons who have completed programs in the Police Academy system, as well as other persons who have completed another (undergraduate) study program, and who are in contact with children in their professional work.

The Faculty of Law Osijek, as the holder and implementer of the Program, will announce a public call for applications for enrollment in the Program no later than thirty days before the start of its implementation, indicating the required application documentation.
