OPIS KOLEGIJA

U okviru predmeta EUROPSKI UPRAVNI POSTUPAK daje se uvid u procesno-pravni aspekt provedbe upravnih postupaka u pravu Europske unije, određuju se temeljna pojmovna određenja procesnih instituta, europskih upravnih standarda i načela (npr. pravo na dobru upravu, pravo pristupa pravosuđu, pravo na izjašnjavanje, pravo na uvid u spis, pravo na djelotvoran pravni lijek i na pošteno suđenje, načelo legitimnih očekivanja, načelo razmjernosti , razuman rok, itd.). Nadalje, značajno je ukazati na učinak i implikacije europskog normiranja (europskih pravnih pravila) na nacionalni upravni postupak. Posebna pozornost bit će posvećena analizi usporedbe i usklađenosti hrvatskog sustava u odnosu na europsko procesno pravo. Cilj je predmeta upoznati studente s primjenom europskih pravila upravnog postupanja, važnosti uključivanja u europski upravni prostor, unapređenja i poboljšanja nacionalnog pravnog okvira, potrebe za kodificiranjem europskog upravnog postupka. Cilj je studentima prikazati izvore europskog upravnog prava i temeljne institucije Europske unije u čijoj su nadležnosti upravni postupci, osobito omogućiti uvid u upravnu i sudsku praksu.

Defiirati temeljne pojmove poput europskog upravnog prava, europskog upravnog postupka, europskog upravnog prostora, temeljnih načela europskog upravnog postupka, europskih upravnih standarda, upravne suradnje, administrativne autonomije, Nabrojati i objasniti izvore europskog upravnog prava i temeljna načela europske javne uprave, Razlikovati institucije koje provode europske upravne postupke i pravne instrumente u europskom upravnom postupku i usporediti s hrvatskim pravnim uređenjem , Povezati osnovne pojmove/institute europskog upravnog postupka s praktičnim primjerima iz hrvatskog upravnog postupka , Primijeniti stečena znanja na rješavanje praktičnih problema putem analize sudske prakse Suda EU, Europskog sud za ljudska prava , Kritički analizirati pozitivno-pravno uređenje u nacionalnom pravu u odnosu na europsko pravo , Izraditi seminarski rad na odabranu temu ili izraditi analizu odabrane prakse Suda EU, Europskog suda za ljudska prava (sažetak presude/odluke),

Studenti su obvezni biti prisutni na minimalno 60% predavanja uz aktivno sudjelovanje (u slučaju više od 10 upisanih studenata) te položiti ispitnu materiju putem pisanog ili usmenog dijela ispita. Studentima će biti dana mogućnost izlaganja određene odabrane tematike na predavanju ili analize konkretnog sudskog predmeta odabranog upravnog područja te će se odabrana aktivnost vrednovati u oblikovanju konačne ocjene, a time i oslobođenja klasičnog polaganja ispita. Nazočnost i sudjelovanje 60% na predavanjima, preduvjeti su podjeljivanja potpisa kao uredno izvršenih studentskih obveza. U slučaju dužeg vremenskog razdoblja nemogućnosti prisustvovanja predavanjima, studenti su dužni opravdati svoje izostanke predmetnom profesoru. U iznimnim situacijama i kada je to opravdano, kolokviji i ispiti održavat će se online putem korištenjem dostupnih platformi (ZOOM, Merlin, Microsoft Teams, Moodle).

COURSE DESCRIPTION
Course content

Within the framework of the subject EUROPEAN ADMINISTRATIVE PROCEDURE, an insight is given into the procedural-legal aspect of the implementation of administrative procedures in the law of the European Union, the basic conceptual definitions of procedural institutes, European administrative standards and principles are determined (e.g. the right to good administration, the right of access to justice, the right to express , the right to inspect the file, the right to an effective legal remedy and to a fair trial, the principle of legitimate expectations, the principle of proportionality, a reasonable deadline, etc.). Furthermore, it is important to point out the effect and implications of European standardization (European legal rules) on the national administrative procedure. Special attention will be devoted to the analysis of the comparison and alignment of the Croatian system in relation to European procedural law. The aim of the course is to acquaint students with the application of European rules of administrative procedure, the importance of inclusion in the European administrative area, the improvement and improvement of the national legal framework, the need for codification of the European administrative procedure. The goal is to show students the sources of European administrative law and the fundamental institutions of the European Union, which are responsible for administrative procedures, especially to enable insight into administrative and judicial practice.

ADDITIONAL FACTS
Students are required to be present at a minimum of 60% of lectures with active participation (in the case of more than 10 enrolled students) and to pass the exam material through the written or oral part of the exam. Students will be given the opportunity to present a certain selected topic in the lecture or analyze a specific court case of the selected administrative area, and the selected activity will be evaluated in the formation of the final grade, and thus exemption from taking the classic exam. Attendance and participation of 60% in lectures are prerequisites for signing signatures as duly fulfilled student obligations. In the case of a longer period of inability to attend lectures, students are obliged to justify their absences to the relevant professor. In exceptional situations and when justified, colloquiums and exams will be held online using available platforms (ZOOM, Merlin, Microsoft Teams, Moodle).
